Lenovo Service Agreement

Lenovo (Australia and New Zealand) Pty Limited ABN 70 112 394 411 Level 10, North Tower, 1-5 Railway Street, Chatswood NSW 2067 (“Lenovo”) confirms receipt of your order and accepts your order and offers service only if (1) you agree to the terms of this Lenovo Incident Support Services Agreement (“Agreement”) and (2) the service is available. As the contractual basis of our relationship, all transactions are governed by the laws of New South Wales, without regard to conflict of laws rules. This Agreement and its appendices or supporting documents constitute the entire agreement between you and Lenovo regarding your acquisition of the Service and supersede all prior oral or written notices between you and Lenovo. If Lenovo does not agree in writing, additional or derogatory terms in an order or written notices from you are not valid. All of your rights and obligations under this Agreement are valid only in Australia. You agree to the terms of this Agreement by accepting the provision of the Service, clicking on these Terms and concluding your transaction when ordering online or, if you order otherwise, according to the acceptance procedures of the relevant Service. We both agree: 1) not all information exchanged is confidential. If one of us requests the exchange of confidential information, this is done within the framework of a signed confidentiality agreement; and 2) all information communicated or provided by Lenovo by telephone or electronically is not proprietary information of customer. Lenovo and our affiliates process, store, and use information about your transaction and contact information, including name, phone numbers, address, and email addresses to process and complete your transaction. Lenovo is unable to provide our services if you refuse to provide your data or if you do not want us to pass on your data to our representative or contractor. You have the right to access your personal details and request correction of errors under the Privacy Act of 1988 by contacting Lenovo.

We may also contact you to inform you of product recalls, security issues or service measures. We may use this information to ask for your satisfaction with our products or services or, if you have given your consent, to provide you with information about other products and services. You can opt out of receiving further messages from us at any time. To achieve these purposes, we may transfer your data to any country where we do business, we may pass it on to companies acting on our behalf or we may disclose it if required by law. We will not sell or transfer the personal data you make available to third parties for their own direct marketing use, unless we clearly inform you and obtain your explicit consent for your data to be transmitted in this way. LENOVO, INCLUDING LENOVO`S SENIOR MANAGEMENT, STAFF, REPRESENTATIVES, CONTRACTORS, SUBCONTRACTORS, SUPPLIERS OR DEVELOPERS OF SOFTWARE PRODUCTS, IS NOT RESPONSIBLE FOR THE FOLLOWING, EVEN IF ADVISED OF THEIR POSSIBILITY: 1) THIRD PARTY CLAIMS; 2) LOSS OF OR DAMAGE TO DATA; OR 3) SPECIAL, INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES OR FOR ECONOMIC DAMAGES, INCLUDING LOSS OF PROFITS, TRANSACTIONS, REVENUES, GOOD GOODS OR EXPECTED SAVINGS.. . .
